Website terms of use
Last updated: 12 October 2026
These terms govern your use of the website at byjoom.com (the Website). By using the Website you accept them. If you do not accept them, please do not use the Website. In these terms "JOOM", "we" and "us" mean SAMADROCK LTD, trading as byJOOM, and "you" means anyone using the Website. Our company information is in the Legal notice.
About these terms
- These terms apply to the Website only. They do not create a contract for design, engineering or any other professional service. An agreement for services is made only in the way described in Working with JOOM: agreements.
- Read these terms together with our Privacy notice, Cookies and similar technologies, Accessibility statement and Disclaimers and representation of projects.
- We may change these terms from time to time. The version on the Website on the day you use it applies, and the date at the top of this page shows when it was last updated. Material changes will not apply retroactively to a dispute that began before the change.
Using the Website
- The Website is free to view. It has no accounts, forms, payments or online ordering.
- You must be able to enter into a binding legal relationship in your country to use the Website for business purposes. Anyone may view it for personal information.
- We try to keep the Website available and accurate but do not promise that it will be uninterrupted, error free or free from harmful components. We may change, suspend or withdraw any part of it at any time without notice.
- You are responsible for your own equipment, connection and security when you use the Website.
Intellectual property
- Ownership. The designs, drawings, models, visualisations and images shown on the Website were created by the designer named in the Legal notice, who owns the copyright and other intellectual property rights in them personally, and they are not owned by any company. The name and trade mark byJOOM are owned in the same way. The text, translations, logos, layout and code of the Website are owned by us or by the designer, or used under licence. Where something on the Website was not created by the designer, we say so and credit its owner. All of this is protected by copyright, trade mark and other intellectual property laws in the United Kingdom, the Arab Republic of Egypt and other countries. All rights are reserved.
- What you may do. You may view the Website, and you may print or save a copy of a page for your own non-commercial reference. You may share a link to any page. You may quote short passages of text with a clear credit to JOOM and a link to the page quoted, where this is permitted by law (including fair dealing for criticism, review or reporting current events).
- What you may not do without our written permission. You may not copy, reproduce, publish, adapt, translate, distribute, display publicly, sell, licence or make commercial use of any image, drawing, text or design from the Website, or use the name or trade mark byJOOM in a way that suggests a connection with us. This includes using project images or designs as a basis for a building, a bid, a marketing item or an artificial-intelligence model.
- Requests. Permission is given only by or on behalf of the owner. For press, publication, competition, academic or other use, write to hello@byjoom.com with the subject "Permission". We will tell you the terms on which we can agree, which may include credit and approval of layout.
- Third-party rights. Where a name, mark, landmark or place appears on the Website, it is shown only to identify a location or context. It does not mean that the owner of that name, mark or place is connected with us or has endorsed us.
- Moral rights. The designer asserts his moral rights as author of the designs, including the right to be identified as author and to object to derogatory treatment, to the fullest extent of the law in each country. The authors of other content assert theirs.
Acceptable use
You must not:
- use the Website in any way that is unlawful, fraudulent or harmful, or for any unlawful purpose;
- scrape, crawl, harvest or copy the Website systematically by automated means, other than ordinary search-engine indexing that respects our
robotsinstructions; - attempt to gain unauthorised access to the Website, its servers or any connected system, or test its security without our written permission;
- introduce malware, overload the Website or interfere with its operation;
- frame the Website or present our content as though it were yours, or suggest a connection with us that does not exist;
- use the Website to send unsolicited commercial messages or to collect addresses for them.
We may block access, take down content and report unlawful activity to the authorities.
Text and data mining and artificial intelligence
We expressly reserve all rights in the content of the Website, including the right to prevent text and data mining and the use of the content to train, fine-tune or ground any artificial-intelligence or machine-learning system. This reservation is made for the purposes of Article 4 of Directive (EU) 2019/790, section 29A of the Copyright, Designs and Patents Act 1988 and any equivalent provision of the law of Egypt, Jordan or elsewhere. Any such use requires our prior written licence.
Links to and from the Website
- The Website may link to websites and email addresses that we do not control. We are not responsible for their content, privacy practices or availability, and a link is not an endorsement.
- You may link to the Website's home page or to any project page, provided the link is fair and legal, does not suggest endorsement and does not damage our reputation. We may withdraw this permission at any time.
No offer and no advice
- Nothing on the Website is an offer capable of acceptance, a quotation, a fee proposal or a promise that we will accept any commission.
- The Website is general information about our work and approach. It is not architectural, engineering, legal, planning, financial, tax or other professional advice, and you should not rely on it as such. See Disclaimers and representation of projects.
- Articles and guides. The articles, guides and other educational content in our Journal and elsewhere on the Website are general information and, in places, our opinion. They are not specifications, instructions, designs or advice. Laws, regulations, standards, products, prices, practices and technology change, and they differ from country to country and sometimes from place to place within a country. An article may be out of date, incomplete or wrong for your circumstances when you read it. Always check current requirements and take advice from suitably qualified and insured professionals (for example an architect registered in the place of your project, a structural or other engineer, a building control body or building authority, a lawyer or a surveyor) before you design, build, buy, invest or otherwise act. We do not accept responsibility for loss that results from relying on general content on the Website, to the extent the law allows.
- Opinion and examples. Descriptions of our approach, of materials, methods, regulations, practices and projects are given as examples and as our views at the time of writing. Where we describe a project that is a concept, it is not a built project and does not show compliance with any requirement.
Our liability to you
- Nothing limits what cannot lawfully be limited. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited by law, including any non-excludable rights of consumers.
- Consumers. If you are a consumer, your statutory rights are not affected. We provide the Website for domestic and private use only and we are not liable for loss of business, profit or opportunity.
- Businesses. If you use the Website for business purposes, then to the fullest extent the law allows: (a) the Website and its content are provided "as is" and "as available" without warranty of any kind; (b) we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, goodwill, data or opportunity arising from your use of or inability to use the Website; and (c) our total liability to you arising from the Website in any period of twelve months is limited to £100 (or its equivalent in your currency).
- We are not responsible for delay or failure caused by events outside our reasonable control.
Suspension and termination
If you break these terms, we may suspend or end your access to the Website and take any other action the law allows. Those parts of these terms which by their nature should continue (including sections on intellectual property, liability and governing law) continue after your access ends.
Governing law and courts
- These terms, and any dispute or claim arising out of or in connection with them or the Website (including non-contractual disputes), are governed by the law of England and Wales.
- The courts of England and Wales have exclusive jurisdiction, except that: (a) if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in the courts of your home nation; and (b) if you are a consumer living outside the United Kingdom, you keep the benefit of any mandatory consumer protection of the country where you live, and may bring proceedings in its courts where that law gives you the right.
- Agreements for services are governed by the law and dispute-resolution provisions in the agreement itself and by Jurisdictions and governing law, not by this section.
General
- Entire terms. These terms, with the pages listed in "About these terms", are the whole agreement between you and us about your use of the Website.
- Severance. If any provision is found to be unlawful or unenforceable, the rest continues in effect and the provision is applied to the extent the law permits.
- No waiver. A delay or failure to enforce a right is not a waiver of it.
- No assignment. You may not assign these terms. We may assign them to a successor to our business.
- Third parties. No one other than you and us has any right to enforce these terms, including under the Contracts (Rights of Third Parties) Act 1999.
- No agency or partnership. These terms create no partnership, joint venture, agency or employment relationship.
- Language. If these terms are translated, the English text prevails to the extent that the law allows.
